The investor follows the cross rate between the EUR and the Japanese yen. He believes that this market is headed for a fall. This requires a margin of EUR 1,000,000 x 5% = EUR 10,000 = approx. USD 52,500 (EUR /USD 1.05).

The dealer quotes 112.05-10. The investor sells EUR at 112.05.

Day 1: Sell EUR 1,000,000 vs. JPY 112.05 = Buy JPY 112,050,000.

Biggest Forex Scam Pt. XI (Whileon Chay)

The tactics employed by the perpetrators of investment frauds had undergone little change in the past century. However, there is no dearth of unsuspecting investors who fall prey to such Ponzi schemes. The reason is that crooks have a clear understanding of the human psychology. Whileon Chay, a New York resident, is one such scammer who successfully capitalized on the greed and crowd behavior.

4X Solutions’ investment scheme

Beginning 2007, Whileon Chay . through his firm 4X Solutions Inc (not to be confused with British VPS provider by 4X Solutions Ltd), started offering an investment scheme to investors. The company was not registered with the CFTC in any capacity. Chay and his wife were the only executives and shareholders of 4X solutions. According to the scheme, the investors’ funds would be pooled together and used to trade currencies, gold and other commodities. To effectuate the bogus scheme, Chay made false representations (verbal and written) about the historical performance of the trading activity.

Furthermore, to convince investors, Chay claimed that he would use only a portion of the pooled investors’ funds to trade in the Forex market, while he would invest the rest in physical gold. Chay also stated that in such a scenario, any downside in the price of gold would be hedged so that the overall asset value continues to grow irrespective of fluctuations in the market. The marketing materials given to some other investors indicated that currency risk is hedged using precious metals. To prospective investors, Chay asserted that the strategy employed to trade the Forex market was so good that it enabled them to earn profits quite easily and safely even during adverse market conditions. Chay also boasted that 4X Solutions did not suffer even a single losing month in the past 14 years and so that was a safe haven investment with the prospects of earning 24% to 36% per year. The high pressure sales pitch coupled with material misrepresentations enabled Chay to receive deposits to the tune of about $4.8 million from 19 investors.

Chain of entities

To hide the fraud from investors and law enforcement agencies, Chay established numerous companies across the US. This includes 4X Solutions, Inc. (Nevada), Ark Atlantic Corporation (Panama), Golden Gateway International, S. A (Panama), The Globe Gateway, Inc. (Las Vegas) and Zheng Formulas LLC (Nevada). The entities were referred to as investment firms engaged in the trading of currencies, gold and other commodities. Chay was the organizer, officer and manager of all the entities. Additionally, Chay opened and maintained several corporate bank accounts in the name of the 4X companies.

Mode of investments

Chay mostly instructed the investors to make deposits through a check payable to one of the 4X entities. Sometimes, he directed the investors to make a wire transfer to one of the corporate accounts held in the name of the 4X entities. At a later stage, when Chay became aware of the fact that Federal investigators are examining the business of the 4X entities, he advised clients to make payments in the form of gold coins or bars.

Trading performance gimmicks

Chay had numerous trading accounts in the name of 4X entities at several Futures Commission Merchants (FCM’s) registered with the CFTC. In all, a sum of $2.995 million was deposited in the trading accounts. The trading accounts authorized only Chay and his wife to trade on behalf of the 4X entities. The trading accounts were corporate proprietary accounts and did not represent the forex investor pool in any manner.

Chay, who did not have any successful record, lost as much as $1,985,754 trading Forex and Forex options. Chay withdrew the remaining $1 million to the corporate bank accounts of 4X entity. The last Forex trading account of Chay was closed on November 4, 2010, and the remaining balance of $11,854 was transferred to the 4X’s corporate bank accounts. A sum of $11,785 was later transferred to his personal account. Chay, however, never declared the trading losses to the prevailing and prospective investors. In fact, the account statements, fabricated by Chay and sent by mail as well as provided online to clients, continued to show a positive appreciation in the net balance. By 2011, the value of assets (calculated using the account statements of the clients), which were purported to be under the management of 4X entities was $16.5 million.

In this regard, a letter sent to the investors of Ark Atlantic claimed that Chay never had a losing month in the past 15 years and for the past four years the clients were making consistent returns of 2.2% on a monthly basis.

Misappropriation of funds

Chay deployed only about $2 million in trading currencies. None of the investors’ funds were used to purchase physical gold as it was claimed while presenting the scheme to the prospective investors. About $1,731,600 was used to pay purported profits to some of the investors. The rest of the money was used to pay Chay’s personal expenses, including but not limited to luxury resorts, high-end restaurants, limousine services and exotic car rentals. Chay, who lost his wife in 2009, also paid $150,000 for cryogenic freezing of her body.

Indictment

Based on several complaints from investors, on April 8, 2013, the CFTC filed an equitable relief and civil monetary penalty against 4X solutions. While the case was under investigation. Chay was believed to have fled to Lima, Peru. Neither he nor any lawyer responded to the court notice. Thus, on January 29, 2016, the honorable court of New York ordered 4X solutions and its principal Whileon Chay to disgorge $2,745,226 and pay a civil monetary penalty of $8,235,678. The US authorities, based on an extradition treaty with Peru, are currently trying to nab Chay, who is now a criminal fugitive. The CFTC warned that even if Chay gets arrested, investors may not see most of their money as the fraudster would not have enough funds or assets for liquidation.

TOKYO, May 19 The euro fell to its lowest in more than four years against the dollar on Wednesday as a sell-off in the single currency gathered pace after Germany's move to ban naked short-selling of some securities rattled investors.

Germany on Tuesday announced a ban that covered some high-risk bets involving euro-denominated government bonds, credit default swaps based on those bonds, and shares in Germany's 10 top financial institutions. [ID:nN18512882]

Analysts said that Germany's regulation would do little to help fix Europe's debt crisis, and that the ban has left foreign exchange as the only market where investors fell free to bet against European assets.

"Stocks and CDS trading are now regulated. The government bond market is supported by the European Central Bank's buying. So investors have no place but the currency market to express their views on Europe," said Masafumi Yamamoto, chief FX strategist Japan at Barclays Capital.

Meanwhile, the dollar and the yen benefited as players sought the safety of the greenback, the world's most liquid currency, and the low-yielding Japanese currency.

The dollar index, which tracks the U. S. unit's performance against a basket of major currencies, rose to a 14-month high of 87.458.DXY=USD.

The euro was down 0.1 percent at $1.2193 EUR=. In early Asian trade, it slid as low as $1.2143 on trading platform EBS, its lowest since April 2006.

Traders said option barriers at $1.22 were taken out and more are lined up at $1.21, $1.20 and right down to $1.15.

The euro's next support is seen at $1.2133, a 50 percent retracement from its all-time low of $0.8225 hit in October 2000 to its record peak of $1.6040 reached on EBS in July 2008.

If that level is broken, the next support level would be at the psychologically important $1.2000.

The euro has fallen about 15 percent against the dollar so far this year, hammered by concerns that Europe's debt problems and austerity measures could hamper the euro zone's economic recovery.

In addition to these fiscal and recovery worries, investors are now eyeing whether other nations will follow Germany as a wider ban could squeeze liquidity in euro zone markets.

Austria's finance ministry is pushing for a Europe-wide ban of naked short-selling of some financial stocks and debt securities, the Financial Times reported on Wednesday. [ID:nSGE64I06R]

Traders said Germany's move limits risks players can take in euro assets, likely prompting investors to shift their funds elsewhere. A wider ban would only spur the outflow of money from the euro zone, putting downward pressure on the single currency, they said.

"There is some sense of security in holding euro assets as long as money is shifting to Bunds from Greek government bonds," said Jun Kato, senior manager of the investment department at Shinkin Asset Management.

"But that would all change if investors started selling government debt in Germany and France, with money fleeing from the euro zone. This regulation has a danger of prompting fund outflows."

Against the Japanese currency, the euro slid 0.4 percent to 112.13 yen EURJPY=R, crawling towards an eight-year low of 110.49 yen struck earlier this month.

The yen rose across the board, lifted by investor risk aversion moves. The higher-yielding Australian dollar dropped 0.9 percent to 78.58 yen AUDJPY=R.

The greenback fell 0.4 percent to 91.91 yen JPY= .

Sterling fell as low as $1.4239 GBP=D4. its lowest since late March 2009. Yesterday I wrote what I believe is one of the most positive reviews I have ever written about a commercial EA. Although the EA is still not worth buying due to some problems with the live tests and the back/live testing consistency it did show substantial promise which 99% of all commercial experts do not show. Sound money management, lack of obvious backtesting exploitations, etc. Today I will write a review about another trading system available by the same company called the forex trend machine. Of course I will evaluate the expert advisor’s statements and the claims made by the authors and I will tell you if I consider this EA worth buying and testing.

It is obvious now to me that the people at the trend machine have put an effort in developing trading strategies that are at least likely long term profitable. Yesterday my analysis of the fade machine showed that they do use volatility adjusted money management and long periods of backtesting to proof the profitability of their trading systems. Their systems are then likely to be able to adapt to changing market conditions as the market evolves in the future.

The forex trend machine shows an interesting attempt to offer a (very) long term trading system which trades the EUR/USD and GBP/USD daily charts. Sadly, the system is just too infrequent in its trading and the number of results is just too limited for us to say anything about the possibility of this trading system to be profitable in the future. The fact that you have to wait at some point 4 years for a new equity high is also something that I don’t definitely like about this trading system. It is true that most long term profitable systems have extended periods of draw down but it is much better to trade and evaluate systems that are not as infrequent traders because the lack of trades makes the statistical significance of the expert’s achievements doubtful.

The fact that the expert trades on the daily charts is a plus since errors inherent to this time frame in backtesting are very limited unless some intentional exploitation is done. However there is also the problem that in order to evaluate if the system is live/back testing consistent we will need at least 5 years at a bare minimum.

I certainly applaud the efforts of the people at the trade machine to program and offer this long term trading system. However they should keep in mind that for a more statistically significant evaluation of a trading system at least 150-200 trades are needed and such an amount is not provided by the system (which takes about 5 trades every year).

For example, the fact that the EUR/USD only made a huge profit near 2003 makes us doubt if the trading system exploited a particular event in 2003 which will not be repeated under other market conditions. We need profitable trades under varied market conditions in order to know that the EA is able to adapt to changes in the market, something which is not provided by such a short number of trades (just near 40 for the 2002-2009 period on the EUR/USD). Since the number of trades is too reduced to make any conclusions about the possibility of this strategy to work in the future I will have to say that this expert advisor is not worth buying or testing. I would certainly encourage the people at the trade machine to design a system that trades a little bit more on the daily time frame such as to make evaluation more significant and the evaluation of future profitability more certain. However this is the first company I see with experts that use money management adapted against market volatility, congratulations on that.
